• Application means the software program provided by the Company used by You on any electronic device, named PupPulse.
• Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
• Account means a unique account created for You to access our Service or parts of our Service.
• Country refers to: Virginia, United States.
• Company (referred to as either "the Company", "We", "Us" or "Our") refers to AppEcho Labs, LLC, Alexandria, VA.
• Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.
• Feedback means feedback, innovations or suggestions sent by You regarding the attributes, performance or features of our Service.
• Free Trial refers to a limited period of time that may be free when purchasing a Subscription.
• Service refers to the Application.
• Subscriptions refer to the services or access to the Service offered on a subscription basis by the Company to You.
• Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
• Third-party Social Media Service means any services or content provided by a third-party that may be displayed, included or made available by the Service.
• You means the individual accessing or using the Service, or the company, or other legal entity on whose behalf such individual is accessing or using the Service, as applicable.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Our Privacy Policy. By accessing or using the Service You agree to be bound by these Terms. If You disagree with any part, You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Placing Orders and Goods

We do not sell physical goods through the Service. If we offer any downloadable or digital materials, they are provided as part of the Service under these Terms.

Subscriptions

Subscription period

Parts of the Service are available only with a paid Subscription. You will be billed in advance on a recurring, periodic basis (for example, monthly) depending on the plan you select. At the end of each period, Your Subscription will automatically renew under the same conditions unless You cancel it or We cancel it.

Subscription cancellations

You may cancel Your Subscription renewal in Your billing settings or by contacting Us. You will not receive a refund for fees already paid for the current Subscription period, and You will continue to have access until the period ends, except where required by law.

Billing

You must provide accurate and complete billing information (full name, address, and a valid payment method). If automatic billing fails, We may issue an electronic invoice for manual payment by a specified due date.

Fee Changes

We may modify Subscription fees. Any change becomes effective at the end of the then-current billing period and after reasonable prior notice, allowing You to cancel before the change.

Refunds

Except when required by law, paid Subscription fees are non-refundable. Certain refund requests may be considered on a case-by-case basis at Our sole discretion.

Free Trial

We may offer a Free Trial at Our sole discretion. You may be required to enter billing information to sign up. You will not be charged until the Free Trial has expired. On the last day of the Free Trial, unless You cancel, You will be charged the applicable fees.

Payments

We process payments exclusively through Stripe. We do not store or collect Your payment card details. Payment information is provided directly to Stripe and is governed by Stripe’s policies and PCI-DSS standards.

User Accounts

You must provide accurate, complete, and current information at all times. You are responsible for safeguarding Your password and for any activities under Your account. Notify Us immediately of any breach of security or unauthorized use of Your account.

Intellectual Property

The Service and its original content (excluding content provided by users), features and functionality are and will remain the exclusive property of the Company and its licensors. Our trademarks and trade dress may not be used without Our prior written consent.

Your Feedback to Us

You assign all rights, title, and interest in any Feedback You provide. If such assignment is ineffective, You grant the Company a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, disclose, sublicense, distribute, modify, and exploit such Feedback without restriction.

Links to Other Websites

Our Service may contain links to third-party websites or services not owned or controlled by the Company. We have no control over and assume no responsibility for their content, privacy policies, or practices. We recommend reviewing any third-party terms and privacy policies.

Termination

We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason, including if You breach these Terms. Upon termination, Your right to use the Service ceases immediately.

Limitation of Liability

To the maximum extent permitted by law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages (including loss of profits, data, or business interruption), even if advised of the possibility. In any case, the Company’s total liability shall be limited to the amount actually paid by You through the Service or 100 USD if You have not made any purchases.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" without warranty of any kind. The Company disclaims all warranties, whether express, implied, statutory or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

Governing Law

The laws of the Country, excluding its conflicts of law rules, govern these Terms and Your use of the Service.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve it informally by contacting the Company.

For European Union (EU) Users

If You are an EU consumer, You will benefit from any mandatory provisions of the law of the country in which You are resident.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country subject to the U.S. government embargo or designated as a “terrorist supporting” country; and (ii) You are not listed on any U.S. government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held unenforceable or invalid, that provision will be interpreted to accomplish its objectives to the greatest extent possible and the remaining provisions will remain in full force and effect.

Waiver

Except as provided herein, failure to exercise a right or require performance under these Terms does not affect a party’s ability to exercise such right or require such performance later, nor does a waiver of a breach waive any subsequent breach.

Translation Interpretation

If We have made these Terms available to You in a language other than English, the original English text shall prevail in case of dispute.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide notice prior to new terms taking effect. By continuing to use the Service after updates become effective, You agree to be bound by the revised Terms.
